The big banks and the credit bureaus have for years pushed and pushed hard for federal laws which pre-empted state laws. (Pre-emption is a legal doctrine whereby a federal law completely displaces a state law on the same topic, rendering the state law null and void.)
The problem for consumers: big business and the finance industry owns Washington, D.C. to an extent unknown in our nation’s history. Of course the federal laws which are passed are watered-down and almost never as tough and as effective at protecting consumers as state laws.
When you become aware that big banks and the finance companies are trying to pass laws on identity theft, credit reporting, etc. which violate your rights as a citizen of your state, write your senators and your congresspersons and tell them to respect state’s rights. Ironically, it is the Republican party which historically has advocated for state’s rights and which now completely favors federal pre-emption of tough state consumer protection laws. It just shows who’s really running the show in Washington, D.C.
